Photo Submission Terms & Conditions Before uploading a photo(s) for submission to the ROUSH Performance Owner's Gallery, carefully read the following terms and conditions. Submission of Photo All photo(s) must be submitted in digital format only via the website; you can submit images taken with a digital camera or images taken with a film-based camera and scanned into a digital format. Submissions that are mailed are not accepted. ROUSH Performance Owner's Gallery I understand that the purpose of the ROUSH Performance Owner's Gallery is primarily to showcase owners' ROUSH Performance vehicles. Since ROUSH Performance is a family-friendly site, I agree it will have the right to review my uploaded photo(s) before publication and reject those having unsuitable images that it alone will determine. I understand that unsuitable images include, but are not limited to, nude photo(s) as well as photo(s) of a sexually suggestive or lewd content. Release of Publishing Rights By uploading my photo(s) I agree that I am assigning ROUSH Performance, its parent, ROUSH Enterprises, Inc., and their related subsidiaries and affiliates (hereinafter individually and collectively called "ROUSH") a non-exclusive, perpetual, unlimited, irrevocable license and right to use my photo(s) and the image(s) depicted on my photo(s) in any format(s) or media worldwide. I understand and agree that my photo(s) will be made available for viewing to the public and I give ROUSH permission to do so. Copyright/Release of Persons Depicted in Photo(s) By uploading my photo(s) I represent and warrant that I own all the rights, including without limitation the copyrights, to distribute and publish the photo(s). (Note, you are automatically the copyright owner of a photo if you took the photo yourself and you did not convey to another party for compensation your copyrights to the photo you took.) I further represent and warrant that I have sufficient written permission of any recognizable models or other persons appearing in the photo(s) to be able to grant to ROUSH the right to publish their image(s), as it appears in my uploaded photo(s), in any format or media worldwide and to grant ROUSH such right. Waiver and Release of Right to Inspect or Approve/Royalties By uploading my photo(s) I agree that I am waiving and releasing any right to inspect or approve the finished photo(s) before publication or the printed or electronic matter that may be used in conjunction with my photo(s), if any, now or in the future; regardless if that use is known to me or unknown. Moreover, I agree to waive any right to royalties or other compensation arising from or related to the use of my photo(s) by ROUSH. Release and Indemnification By uploading my photo(s), I agree to release, defend, indemnify and hold harmless ROUSH and their directors, officer, shareholders, employees, representatives and agents, including any firm publishing and/or distributing the finished product in which my photo(s) is reproduced in whole or in part, whether on paper, electronic media or any other format or media, from and against any claims, damages or liability arising from or related to the use/publication of my photo(s) and the image(s) thereon, including but not limited to any misuse, distortion, blurring, alteration, optical illusion or use in composite form, either intentionally or otherwise, that may occur or be produced in taking, processing, reduction or production of the finished product in which my photo(s) is reproduced, published or distributed. Ability to Contract By uploading my photo(s) I represent and warrant that I am 18 years of age or older and I am competent to contract in my own name.
